Chapter I General

Article 2 These Measures apply to the safe management of the production, operation, storage, use and transportation of hazardous chemicals in the administrative areas of this Province.
Disposal of hazardous chemicals shall be carried out in accordance with the laws, regulations and rules concerning environmental protection.
Article 3 Units engaged in the production, operation, storage, use and transportation of dangerous chemicals (hereinafter collectively referred to as hazardous chemicals units) shall implement the main responsibility of safety production in accordance with relevant laws, regulations and rules, and establish a safety production responsibility system and safety management for all employees. Rules and regulations, ensure safe production investment, implement safety education and training for all employees , improve safety production conditions, promote safety production standardization, and improve safety production.
Article 4 Hazardous chemicals units shall establish a safety production risk grading management and control mechanism, conduct regular safety production risk investigations, determine the risk levels according to the risk points, and make warnings and warnings, and take corresponding risk management and control measures to ensure safety. produce.
Hazardous chemicals units shall establish a safety production hazard investigation and management system, regularly organize safety inspections, timely identify and eliminate hidden dangers, and be responsible for the investigation and management of hidden dangers.
Article 5 The people's governments at or above the county level shall strengthen their leadership over the safety management of hazardous chemicals, formulate and organize the implementation of safe production safety plans for hazardous chemicals in accordance with the national economic and social development plans; establish a coordination mechanism for the safety supervision and management of hazardous chemicals, and timely Coordinate and solve major problems in the safety supervision and management of hazardous chemicals.
The township people's government, sub-district offices, and development zone management agencies shall, in accordance with their duties, strengthen supervision and inspection of the safe production of hazardous chemical units within their respective jurisdictions.
Article 6 The relevant departments of the safety production supervision and management , public security , transportation and other safety supervision and management of the production, operation, storage, use and transportation of dangerous chemicals by the people's governments at or above the county level (hereinafter collectively referred to as the hazardous chemical safety supervision and administration departments) Within the scope of their respective duties, they are responsible for the safety supervision and management of hazardous chemicals ; other relevant departments shall supervise and manage the safety of hazardous chemicals in relevant industries and fields in accordance with their duties .
Chapter II Safety in Production, Storage and Use
Article 7 The people's governments at or above the county level shall organize relevant departments to formulate the layout plans for the production and storage of hazardous chemicals, and plan and rationalize the production and storage of hazardous chemicals.
The people's government at or above the county level shall set up a chemical park (concentration area) dedicated to the production and storage of hazardous chemicals, and shall report it to the people's government at the next higher level for approval.
Article 8 Construction projects for the construction, storage and expansion of hazardous chemicals , as well as construction projects with hazardous chemicals, shall comply with the relevant hazardous chemicals industry layout plan.
Construction projects shall be surveyed, designed, constructed and supervised by units with corresponding qualifications. Construction, survey, design, construction and supervision units are responsible for the quality and safety of the construction projects.
Article 9 In addition to gas stations, gas stations and supporting projects for other industries or construction projects in port areas, new or expanded hazardous chemicals construction projects shall be in accordance with the relevant hazardous chemicals production and storage layout plan , in chemical parks (concentration areas). ) established within.
Where the production facilities and storage facilities of existing hazardous chemical production and storage units are not in the concentrated areas of hazardous chemicals, they shall be gradually moved into chemical parks (concentration areas) in accordance with the industrial layout policy .
Article 10 Where hazardous chemical production, storage and use units of dangerous chemicals are listed in the national key supervision and management list, hazardous chemical processes, hazardous chemicals and major hazards, automatic control systems, safety interlocks, emergency shall be set according to process safety requirements. Parking system and video surveillance system. Safety instrumented systems should also be installed for large and medium-sized chemical plants specified by the state.
Equipment and facilities involved in the distillation, evaporation, drying, crystallization, solvent recovery, waste liquid treatment and other distillation (evaporation) processes involving flammable, explosive and toxic and hazardous materials shall adopt corresponding automatic control, pressure relief, exhaust gas disposal, etc. Safety measures.
Article 11 The newly developed production process of hazardous chemicals shall be gradually extended to industrial production on the basis of small test, pilot test and industrialized test, and no pilot or industrial test of new process shall be carried out on the production device.
The production process of hazardous chemicals adopted for the first time in China shall be carried out in accordance with the provisions for safety and reliability demonstration.
Article 12 The person in charge of the production or technology of the production , storage and use of hazardous chemicals shall have the corresponding chemical engineering and safety knowledge and management capabilities in accordance with the regulations, and shall be qualified by the competent hazardous chemicals safety supervision and administration department. . There is no charge for assessment.
Article 13 The units responsible for the production, storage and use of hazardous chemicals shall establish a special operation safety management system for inspection, maintenance, hot work and limited space. Before the operation, the inspection and maintenance operation plan shall be formulated. After the risk assessment, the main responsible person of the unit shall sign it; the risk analysis, isolation and replacement, safety measures and technical disclosure in the implementation process shall be recorded in writing. Where an outsider is employed, the relevant qualifications and qualifications of the operating unit and personnel shall be inspected, a safety management agreement shall be signed , and safety supervision shall be implemented throughout the operation.
The production, storage and use of hazardous chemicals shall carry out relevant safety management regulations such as risk identification and ticket approval for special operations such as hot fire and limited space. Safety training should be carried out before the operation, and it is determined that the special person carries out on-site operation safety management and controls the number of worksites. It is not allowed to carry out mutually contraindicated operations at the same time and at the same place.
Encourage the production, storage and use of hazardous chemicals to entrust professional technical service agencies and industry associations to conduct on-site safety management of special operations such as inspection and maintenance, hot work and limited space.
Article 14 The units responsible for the production, storage and use of hazardous chemicals shall formulate corresponding plans for the pilot production of construction projects and the driving and parking of chemical plants, and carry out safety conditions confirmation and risk analysis, and implement various safety management and emergency safeguard measures.
Article 15 The units responsible for the production, storage and use of hazardous chemicals shall establish a safety management system and operating procedures for the storage of dangerous chemicals, and classify and separate the dangerous chemicals in special warehouses and special sites, and shall not exceed the range and store excessively. If the incompatible materials are stored in storage or the explosives, wet burning articles, and highly toxic chemicals are stored in the open air, the public alarm system such as alarm, interlocking system, air supply and gas supply shall not be arbitrarily deactivated.
The hazardous chemical tank area shall not be free to change the storage medium or over-temperature, over-pressure, and over-liquid level operations, and shall not be operated without approval or under unsupervised conditions.
Chapter III Operational Safety
Article 16 Units engaged in the operation of dangerous chemicals shall obtain business licenses according to law.
Where there are more than two business premises for a dangerous chemical business unit, the business license shall be obtained separately according to law.
Article 17 The people's governments at or above the county level shall take measures to encourage and support social forces to build a centralized trading market for dangerous chemicals, and guide centralized trading, unified management, special storage, and professional distribution of dangerous chemicals business units; safety production supervision and management, public security The departments of industry and commerce administration, environmental protection, quality and technology supervision and other departments shall supervise and manage the construction and operation of the centralized trading market for dangerous chemicals in accordance with their respective duties.
The promoters of the centralized trading market shall separate the hazardous chemicals management and storage areas from the living areas in accordance with the regulations, and functionally partition the market according to the dangerous characteristics of the chemicals stored and traded in the market, and set up storefront trading areas, temporary storage areas, and special Functional areas such as storage areas and dedicated parking areas. Safety functional zones and safety warning signs shall be set in each functional area to ensure safe distance and smooth evacuation channels, and safety facilities, equipment and fire-fighting facilities and equipment shall be configured in accordance with relevant national standards.
The promoters of the centralized trading market shall set up special security management agencies, equipped with full-time security management personnel, and implement unified security management.
Article 18 Where a hazardous chemical business unit stores dangerous chemicals, it shall be implemented in accordance with the provisions of these Measures concerning the storage of hazardous chemicals.
Hazardous chemicals retail business units shall store dangerous chemicals in small-sized civilian packaging in their business premises, and the total amount shall not exceed the limit set by the State.
Article 19 A business unit of a dangerous chemical shall not sell a highly toxic chemical, a precursor or a flammable chemical, or a non-destructive dangerous chemical to a unit that does not have the corresponding permit or document. Highly toxic chemicals.
The sales and purchase units of highly toxic chemicals, precursor chemicals or explosive chemicals shall be reported to the public security organs of the local county (city, district) people's government for the record of the varieties, quantities and flow information sold and purchased according to the prescribed time limit. .
Chapter IV Pipeline Safety
Article 20 New construction, reconstruction or expansion of dangerous chemicals pipeline construction projects shall obtain administrative licenses according to law, and conduct survey, design, construction, supervision and completion acceptance according to statutory conditions and standards.
Article 21 If the following construction operations are carried out within the scope of pipeline safety protection, which may endanger the safety of dangerous chemical pipelines, the construction unit shall take corresponding protective measures to notify the units that have ownership or operation management rights for the dangerous chemicals pipelines. (hereinafter referred to as the pipeline unit):
(1) crossing or crossing the pipeline;
(2) Build, rebuild or expand railways, highways, river channels, erect power lines, bury underground cables and optical cables, and install safety grounding bodies and lightning strike grounding bodies within the scope of the pipelines and their ancillary facilities prescribed by the State;
(3) Performing blasting, seismic exploration or engineering excavation, engineering drilling, mining, etc. within the scope of the pipelines and their ancillary facilities specified by the State.
The construction unit shall also inform the pipeline unit in writing of the construction plan before the start of construction, jointly formulate an emergency plan and take safety protection measures. The pipeline unit shall assign a special person to conduct on-site supervision.
Article 22 The pipeline unit shall set up safety signs or warning signs within the scope of the pipelines and their ancillary facilities prescribed by the State, regularly inspect and repair the pipelines, find out the hidden dangers in time, and report the treatment to the local authorities. County (city, district) people's government safety production supervision and management department.
Article 23 The pipeline unit shall provide safety notification to the units and residents in the vicinity of the pipeline and its ancillary facilities; formulate special emergency plans according to the dangerous characteristics of the transport medium, and organize at least one emergency drill every year.
Article 24 For pipelines that are used, dismantled or changed, the pipeline unit shall take effective measures to deal with it in a timely manner, and report the disposal plan and disposal situation to the safety production supervision and administration department of the local county (city, district) people's government for the record. The safety production supervision and administration department shall, in conjunction with environmental protection, public security and other departments, supervise and inspect the disposal situation.
Chapter V Transportation Safety
Article 25 Units engaged in the road and waterway transportation of dangerous chemicals shall obtain an administrative license according to law, and take corresponding safety protection measures according to the dangerous characteristics of dangerous chemicals, and equip with necessary protective equipment and emergency rescue equipment.
Where hazardous road vehicles transporting hazardous chemicals outside the province are engaged in the transportation of dangerous chemicals in the province, they shall be reported to the competent transportation department of the people's government at or above the county level in accordance with state regulations.
Article 26 The public security organs of the people's governments at or above the county level shall determine the areas, roads and time where road transport vehicles for dangerous chemicals in their respective jurisdictions are prohibited from passing through, and set clear signs and make them public. Vehicles carrying dangerous chemicals shall not enter restricted areas without the approval of the public security authorities.
The people's government at or above the county level shall, in conjunction with local conditions, construct or determine a special parking lot for road vehicles for dangerous chemicals. No parking lot for dangerous chemicals may be built in the urban area.
Article 27 The road transport unit of hazardous chemicals shall establish a safety management system for dangerous chemicals transportation and a technical file for transportation vehicles, determine the technical management personnel of full-time vehicles, and be responsible for vehicle maintenance and technical services.
Hazardous chemical road transport vehicles shall meet the safety technical requirements required by national standards and conduct regular safety technical inspections in accordance with national regulations. Hazardous Chemicals Road transport tank vehicles (including tank trailers) shall also be equipped with emergency cut-off devices in accordance with national regulations, and shall not alter the nature of use of the vehicles.
Article 28 Where hazardous road vehicles are required to stop during transportation due to maintenance, driver accommodation, etc., appropriate safety precautions shall be taken. Where transporting highly toxic chemicals or explosive chemicals, it shall be reported to the public security organ of the local county (city, district) people's government.
The expressway service area shall be equipped with a special hazardous chemical road transport vehicle parking area and equipped with necessary emergency disposal materials and equipment.
Article 29 The roads and water transport units of hazardous chemicals shall, through satellite positioning systems or on-board automatic identification systems, conduct full-process monitoring of dangerous chemicals transport vehicles and ships. The competent transportation department and the maritime administrative organ shall, in accordance with their respective duties, supervise and inspect the monitoring and control of dangerous chemicals transport units in accordance with the law.
Article 30 The shipper of dangerous chemicals shall abide by the following provisions:
(1) Checking the carrier's dangerous chemicals transportation qualification certificate or record certificate, and copying it together with the freight document;
(2) Providing the carrier with a safety technical specification for the hazardous chemicals, and giving written information such as the name, quantity, hazard characteristics, and emergency disposal measures;
(3) It is forbidden to carry dangerous chemicals in ordinary goods, not to report dangerous chemicals, and not to report dangerous chemicals as ordinary goods.
(4) Other provisions of the State and the province regarding the safe management of the transportation of dangerous chemicals.
Article 31 The carrier of dangerous chemicals shall abide by the following provisions:
(1) Checking the shipper's production and operation license for dangerous chemicals, and copying it together with the freight document, and transporting dangerous chemicals for units without corresponding licenses;
(2) If the dangerous chemicals, precursors, destinations, consignees, etc. are transported as highly toxic chemicals, precursors, consignees, etc.
(3) Checking the name and quantity of dangerous chemicals before loading, and checking the packaging conditions, and not carrying dangerous chemicals that are damaged or fail to meet the packaging requirements;
(4) setting a uniform safety warning sign at the specified position of the transport vehicle or the ship, and displaying the special signal in accordance with the regulations;
(5) equipping transport vehicles with escort personnel and ensuring that the dangerous chemicals transported are under the supervision of escort personnel;
(6) Other provisions of the state and the province regarding the safe management of the transportation of dangerous chemicals.
Article 32 The loading and unloading operations of dangerous chemicals shall comply with the safe working standards, regulations and systems, and shall be carried out under the on-site command or supervision of the loading and unloading management personnel, and shall not exceed the specified load and limit loading dangerous chemicals. The loading and unloading management personnel shall obtain the qualifications for employment in accordance with the state regulations.
